This is a transcript of Henry Scanes Will sent to me by Colin Davis, a copy of the Will can be found framed in the Lounge Bar of the New Inn, Broadclyst, Devon.
THIS IS THE LAST WILL AND TESTAMENT of me
HENRY SCANES of Broadclist in the County of Devon yeoman - I bequeath to me dear Wife Elizabeth Scanes, All the furniture and effects which may at the time of my decease be in the best Bed-room of my House and such Furniture in the Parlour as she may select to furnish a Room with--I also give to my Wife absolutely All my Estate and Interest in Shuter's Hill or Pulman's Tenement in Lease to me from the Chamber of Exeter situate in the Parish of Broadclyst I devise to my said Wife for her life if she shall so long continue my Widow she keeping the buildings insured against Fire and in good repair the House called The New Inn and its appurtenances and the four acres of Land adjoining thereto and occupied therewith situate at Broadclist Heath in the said Parish of Broadclist and after her death or second Marriage I devise the same to my Son Samuel Tuck Scanes his heirs and assigns for ever - I devise all my Freehold Farm and Lands in the said Parish of Broadclist called Farthings devised to me by my Grandfather unto my eldest Son Henry John Scanes his heirs and assigns for ever. Subject nevertheless to the obligation of his paying such a sum or sums of money as with the amount now standing in the joint names of William Richard Bishop of Exeter Solicitor his son Preston Bishop and myself in Messrs. Sanders Bank at Exeter will make up the two Legacies directed by my Grandfather to be raised out of Farthing's Estate on the respective deceases of my Mother and Aunt - for their Children and to the payment of the Annuities payable to my said Mother and Aunt in exoneration of the property given to the said Samuel Tuck Scanes and subject also to the payment of all monies now owing by me to Mr. William Higgins Solicitor Exeter and subject also to his allowing my said Wife and Son Samuel Tuck Scanes to share with him the benefit of the Estate until the sale of Trow - I devise and bequeath unto my said Wife Elizabeth Scanes and my Sons Henry John Scanes and Samuel Tuck Scanes All that my Freehold Farm and Lands called Trow Farm situate in Broadclist Devon and the growing and other Crops live and dead stock and implements of Husbandry and the residue of my Household Goods and Furniture Upon trust to sell and dispose of the same in such manner at such time or times within Eight years after my decease as they shall in their uncontrolled discretion think fit and meanwhile for their respective benefits and to be managed and dealt with as they shall think fit And after payment of my just debts (except as aforesaid) funeral and testamentary expenses to divide the proceeds equally between all my Children viz: the said Henry John Scanes, Samuel Tuck Scanes and Elizabeth Mary Davis and Charlotte Dunn who either already have or shall attain the age of twenty one years or die under their separate use and their receipts to be good discharges for their Shares. And I give all the residue of my property equally between my said four Children. AND I APPOINT my said Wife ELIZABETH SCANES and my Sons HENRY JOHN SCANES and SAMUEL TUCK SCANES EXECUTRIX and EXECUTORS of this my Will IN WITNESS whereof I have hereunto set my hand this ninth day of October One thousand eight hundred and sixty one Henry Scanes
SIGNED and declared by the said Henry Scanes the Testator as his Will in the presence of us present at the same time who at his request in his presence and in the presence of each other have hereunto subscribed our names as Witnesses
